MOBILE APPS – Terms of Use
BY DOWNLOADING, INSTALLING, AND USING MYACUVUE MOBILE APPLICATION ("MyACUVUE®") IT CONSTITUTES YOUR ACCEPTANCE AND ACKNOWLEDGMENT OF THE FOLLOWING TERMS OF USE ("TERMS"), WHICH MAY BE REVISED BY JOHNSON & JOHNSON SDN BHD ("J&J") FROM TIME TO TIME, AND IS A BINDING AGREEMENT BETWEEN YOU AND J&J GOVERNING THE USE OF MYACUVUE. PLEASE UNINSTALL MYACUVUE IMMEDIATELY IF YOU DO NOT AGREE TO THESE TERMS.
Eligibility
MyACUVUE® shall only be used by individuals aged eighteen (18) years or older. If you under the age of eighteen (18) years, you should review these Terms with your parent and/or guardian to make sure that you and your parent and/or guardian understand them.

With your consent, we will collect, use and process your following personal information

including your reviews or surveys of and transaction details in our partner stores (collectively, “Personal Information”), to enable J&J and/ or its authorized third-party service providers and business partners to
[a] create and maintain your MyACUVUE® account with J&J,
[b] conduct marketing and consumer research and data analysis,
[c] send you marketing communications on MyACUVUE®,
[d] manage the MyACUVUE® members’ reward program, including redemption of rewards points, under the MyACUVUE® Malaysia Loyalty Programme,
[e] better understand and improve ACUVUE® customer service experience in order to serve customers,
[g] and carry out the purposes described in the J&J Privacy Policy.
By installing the MyACUVUE® App, you expressly give us consent to collect and process your Personal Information for the above purposes.
Acceptable Use
Usage of MyACUVUE® and any Content and Personal Information transmitted in connection with MyACUVUE® is limited to the contemplated functionality. You agree that your use of MyACUVUE® and any Content must comply with these Terms and the J&J Policies. In no event may MyACUVUE® be used in a manner that (a) harasses, abuses, stalks, threatens, defames or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent or deceptive; (c) uses technology or other means to access MyACUVUE®, J&J Website or Content that is not authorized by J&J; (d) uses or launches any automated system, including without limitation, "robots," "spiders," or "offline readers," to access MyACUVUE®, J&J Website or Content; (e) attempts to introduce viruses or any other computer codes, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) attempts to gain unauthorized access to J&J computer network or user accounts; (g) encourages conduct that would constitute a criminal offense, or that gives rise to civil liability; (h) violates these Terms; (i) attempts to damage, disable, overburden, or impair J&J’s servers or networks; or (j) fails to comply with applicable third party terms (collectively “Acceptable Use”). J&J reserves the right, in its sole discretion, to terminate your User License, terminate your participation with respect to Content or use of MyACUVUE®, that J&J reasonably believes is or might be in violation of these terms of Acceptable Use or J&J Policies, but J&J’s failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
No Warranties
J&J IS PROVIDING MyACUVUE® TO YOU "AS IS" AND YOU ARE USING MyACUVUE® AT YOUR OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, J&J DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OR CONDITIONS THAT THE APPLICATION IS MERCHANTABLE, OF SATISFACTORY QUALITY, RELIABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, NON-INFRINGING OR FREE OF DEFECTS OR ERRORS OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF MyACUVUE® BY YOU IS IN COMPLIANCE WITH LAWS APPLICABLE TO YOU OR THAT PERSONAL INFORMATION TRANSMITTED IN CONNECTION WITH THE APPLICATION WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED.
Changes
J&J reserves the right to change or modify these Terms or any other J&J’s policies related to use of MyACUVUE® at any time and at its sole discretion by posting revisions on J&J’s Website. Continued use of MyACUVUE® following the posting of these changes or modifications will constitute acceptance of such changes or modifications.

MyACUVUE® is a point accumulation rewards program where you are allowed to redeem and enjoy promotional rewards based on the accumulated points over a period of time.
